Family Sponsored Immigration
Spouses, children, parents, and siblings of U.S. citizens, and spouses and children of legal permanent residents may apply to obtain legal permanent resident status (green card) in the United States. An experienced immigration lawyer at Nayar & McIntyre, LLP can assist you with a wide range of family reunification immigration services, including Immigrant Visa Petitions (I-130), Adjustment of Status, Consular Processing, Removal of Conditional Residency (I-751), Fiancée Petitions (K1), K3 and K4 Visas, and V Visas.

Deportation and Removal Defense
Our immigration law firm provides representation before the Immigration Court and Board of Immigration Appeals. Our experienced immigration attorneys have successfully litigated the following forms of relief before the Executive Office for Immigration Review: cancellation of removal, adjustment of status, 212(c), asylum, relief under the Convention Against Torture, TPS de novo relief, voluntary departure, termination of proceedings, waivers for crimes, fraud and unlawful presence, and NACARA. We have also successfully prepared motions to reopen and reconsider. Our immigration lawyers also assist detained individuals to seek bond before the Immigration Judge. Finally, certain individuals may qualify for prosecutorial discretion and administrative closure or termination of their case. Our attorneys have successfully obtained prosecutorial discretion in numerous cases.

Citizenship
Many individuals acquire U.S. citizenship through parents and grandparents, often unbeknownst to them. During your initial consultation, an experienced citizenship lawyer will review your family history to uncover any claims to U.S. citizenship. If you are a U.S. citizen through acquisition, an immigration attorney in our office can help you apply for a U.S. passport or certificate of citizenship.

Naturalization
A naturalization attorney at Nayar & McIntyre, LLP can assist you with your naturalization application. In addition to preparing your naturalization application, our immigration attorney will help you prepare for the interview and provide representation at the interview before Citizenship and Immigration Services. Our naturalization lawyer can also assist you with obtaining a waiver of the English and civics testing requirements for naturalization due to physical or developmental disability or mental impairment (N-648). Relief for Victims of Crime
Victims of domestic violence, child abuse, and other violent crimes are eligible for several forms of relief, including under VAWA, before Citizenship and Immigration Services and the Immigration Court. Our lawyers have several years of experience assisting victims of crime to obtain legal status, employment authorization, deferred action, U visas, cancellation of removal, and legal permanent resident status.

Waivers and provisional waivers
Certain criminal activity, immigration violations (including unlawful presence, status violations, and prior deportations), fraud, and some health conditions can render individuals ineligible to receive immigrant and nonimmigrant visas. Nayar & McIntyre, LLP can help you to obtain waivers for these grounds of ineligibility from Citizenship and Immigration Services, both here in the United States and at consulates abroad. We have successfully filed numerous I-601, I-601A and I-212 waiver applications.

Deferred Action for Childhood Arrivals
On June 15, 2012, the Secretary of Homeland Security announced that certain people who came to the United States as children and meet several guidelines may request consideration of deferred action for a period of two years, subject to renewal. They are also eligible for work authorization. Our office can help assess your eligibility for and file your deferred action for childhood arrivals (DACA) application.

NACARA

Humanitarian Parole

Humanitarian parole is used to bring someone who is otherwise inadmissible into the United States for a temporary period of time due to a compelling emergency. We have successfully obtained humanitarian parole for individuals experiencing a medical or family emergency.

Temporary Protected Status

The Secretary of Homeland Security may designate a foreign country for Temporary Protected Status (TPS) due to conditions in the country that temporarily prevent the country’s nationals from returning safely, or in certain circumstances, where the country is unable to handle the return of its nationals adequately (eg. due to ongoing armed conflict or environmental disaster).  USCIS may grant TPS to eligible nationals of those countries who are already in the United States. During a designated period, individuals who are TPS beneficiaries are not removable from the United States and can obtain an employment authorization document. Our experienced immigration lawyers regularly handle TPS applications for qualifying individuals.
